Coverage Details
The Employees' Compensation Act 1923 mandates specific compensation amounts. A WC policy pays these amounts directly, protecting the employer from personal liability.
| Benefit Type | Statutory Entitlement | Calculation Formula | Typical Maximum | Waiting Period |
|---|---|---|---|---|
| Accidental Death | Lump-sum to family | 50% × Monthly Wages × Age Factor (min. 1,20,000) | No cap under Act | None — immediate |
| Permanent Total Disablement | Lump-sum | 60% × Monthly Wages × Age Factor (min. 1,40,000) | No cap under Act | Yes, a waiting period applies under Section 4(2): No compensation if disablement ≤ 3 days If disablement exceeds 3 days, compensation is payable: From 4th day onwards, OR From 1st day, if disablement lasts 28 days or more |
| Permanent Partial Disablement | Proportional compensation | 60% × Monthly Wages × Age Factor × Disability % | Proportional to injury and Capping on wage for calculation: Salary > 15,000 → consider only 15,000 | None — immediate |
| Temporary Total Disablement | Periodic payment | Half-Monthly Compensation = 25% × Monthly Wages | Up to 5 years and Capping on wage for calculation: Salary > 15,000 → consider only 15,000 | 3-day waiting period |
| Medical Expenses (Optional Add-on) | Hospitalisation & treatment | Actual costs | 25,000 (minimum); higher available | None — immediate |
| Funeral Expenses (Optional Add-on) | One-time | Fixed | 15,000 | None |
* Monthly wages are capped at 15,000 for compensation calculation under the ECA 1923. Age factors range from 228.54 (age 16) to 99.37 (age 65+) under Schedule IV.
Real-World Scenarios
Three actual claim scenarios showing how the Employees' Compensation Act formula translates into real payouts — and how a WC policy protects the employer.
Permanent Partial Disablement
Ramesh, a 34-year-old mason at a high-rise construction site in Pune, falls from a second-floor scaffold and suffers a crush injury resulting in amputation of his dominant hand. Loss of one hand = 60% loss of earning capacity under Schedule I.
💰 10.5 Lakh — paid by WC insurer directly to Ramesh; employer's liability extinguished
Fatal Accident
Suresh, a 28-year-old electrician working on a high-tension cabling project near Bengaluru, is fatally electrocuted when an unmarked live wire is struck during trenching. His widow and two children are the legal dependants.
💰 16.17 Lakh — paid to dependants; contractor fully protected against personal liability
Medical Expenses + Temporary Disablement
Priya, a 26-year-old housekeeping worker deployed at a corporate campus in Mumbai, slips on a wet floor while carrying supplies, fracturing two vertebrae. Hospitalised 3 weeks, unable to work 90 days.
💰 12.07 Lakh — covered; employer has no out-of-pocket expense
Buyer's Guide
WC insurance is deceptively simple on the surface, but contractors routinely buy the wrong cover. Here are the six most common issues — and how to avoid them.
Many contractors insure a fixed list of workers, but site workforce changes daily — new labourers hired, subcontract labour brought in. If an unlisted worker is injured, the claim is rejected.
Request unnamed workmen cover with declaration basis
Headcount grows during the project but the policy is never updated. At claim time, the insurer finds the worker is not on the policy schedule and declines.
Add an endorsement every time headcount changes significantly; or use unnamed cover
A policy issued for 'helper / unskilled labour' may not cover a skilled mason or electrician. The insurer may claim the occupation was mis-described.
List all occupations specifically — masons, carpenters, electricians, supervisors
Basic WC policies focus on compensation (death/disablement) but do NOT automatically include medical expenses. Hospitalisation costs must be added as a specific extension.
Always add the medical expenses extension — adds 10–20% to premium but covers the most frequent claims
Some policies are issued for a single project site. When workers are moved to a different site, they may not be covered if the new location is not endorsed.
Request an 'all sites' or 'any site in India' endorsement if operating across locations
Large clients (government contracts, PSUs, MNCs) require a WC policy showing them as Principal Employer. A standard policy without this endorsement will not satisfy the contractual requirement.
Specify the principal employer's name and have it endorsed on the policy at inception

Know the Difference
Many employers confuse ESI (Employees' State Insurance) with WC insurance. They serve different workers and purposes.
| Parameter | ESI (ESIC Scheme) | WC Insurance (ECA 1923) |
|---|---|---|
| Who is covered | Employees earning up to 21,000/month in registered establishments | All workers in Schedule II industries, regardless of salary |
| Administered by | ESIC (government body) | Private insurers via IRDAI-licensed brokers |
| Premium payment | Employer (3.25%) + Employee (0.75%) contribution | Employer pays 100% of premium |
| Contract / casual workers | Not covered under ESI | Covered, including unnamed labourers |
| Site / field workers | Only if employer is registered and worker is under 21K | Covered across all sites, any location in India |
| Injury compensation | Limited sickness / injury benefit | Full statutory compensation under ECA 1923 |
| Death / disablement | Dependants benefit — limited | Full lump-sum per ECA formula |
| Issuance speed | Registration-based — ongoing | Policy issued digitally within minutes |
Indicative Pricing
Premium is based on annual wage bill per 1,00,000. Actual rates depend on insurer, location, and claim history.
